Agreement to these terms

These Terms & Conditions ("Terms") govern your access to and use of smallbatchagency.com and any content, features, or services offered on or through it (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are a contract between you and Small Batch Agency ("Small Batch," "we," "us," or "our"), a limited liability company organized under the laws of the State of Nebraska.

What the Site is

The Site is an informational resource about Small Batch Agency and the marketing consulting services we offer. Nothing on the Site constitutes an offer to enter into a services agreement. Any client engagement is governed by a separate signed engagement letter or master services agreement, which supersedes any inconsistent statement on the Site.

You may access and use the Site for lawful personal and business purposes. You agree not to:

  • Use the Site in any way that violates applicable law or these Terms.

  • Copy, reproduce, republish, or exploit any part of the Site for commercial purposes without our written permission, except as expressly permitted in Section 4.

  • Interfere with, disrupt, or overload the Site or any network connected to it.

Limitation of liability

In any event, our total liability for all claims arising out of or related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

Governing law and disputes

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Nebraska, and you consent to the personal jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

Termination

​

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. The sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

Severability

​

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
